  • BOTL UPCOMING MAINTENANCE

    Hi Everyone, as mentioned in my introduction post, BOTL needs quite a bit of updating, patching and whatever else I might come across. Over the next few weekends BOTL may be unreachable on occasion as I do migrations or updates, etc. Just be patient - we'll be back! I'll generally try to keep these maintenances until later in the evenings.

Have you ever been stopped for a moving violation? If so you were technically under arrest until the officer lets you go.

That doesn't sound right to me.

Innocent until proven guilty. Even if it is a moving violation, you are not under arrest. Just issued a summons...

In 1990, myself and most of the junior enlisted members of the 366th Security Police Squadron managed to get ourselves thrown in jail for the night. Nothing ever went on record, simply because the First Seargant decided that putting 22 names of his squadron on the police blotter was probably going to relfect badly on his enlisted personel.

In 1993, the entire detachment from the 35th wing from Kunsan ab in Korea got thrown in jail for having a "spirited argument" with a bunch of U.S Marines. Basicaly, we outnumberd them 2 to 1, and we got our ass's handed to us. Since our commander was also involved, (started the fight), nothing ever went into any of our records.

In 2000, I got tossed in jail in a tiny town called Mt. Ranch, CA. for a smart comment to a rookie sherrif. The upshot was my telling a cop "I'm old enough for you to call me SIR". After spending the night in the drunk tank, I went to court, pleaded not guilty, got a lawyer, and then got all the charges thrown out of court, and my record cleared.

Lessons learned.........don't smart off to a cop unless you have a good lawyer.

I always viewed being under arrest when the officer told you that you were under arrest and then read you your rights. But then again, I'm not a lawyer :smile:

BUT,
Innocent until proven guilty. Even if it is a moving violation, you are not under arrest. Just issued a summons...
innocent until proven guilty has nothing to do with arrest, since everyone who is arrested and held with/without bond is still under the presumption of innocence.

The best thing I was ever arrested for was inciting a riot back in '86. Funny thing was it wasn't me who started it. It was reduced to disorderly conduct.

I miss those punk rock days.
