This guy sounds like he knows what he is talking about. He is spouting facts and experience.

Bottom line: expect somewhere between a .1 and 1.00 increase per stick. The $1 increase only likely affecting the very very limited fancy sticks. Most will be in the .10 increase range.

The sky isn't falling and the gubmint is not out to get you.
Thanks for the info. Although I think we should still keep the energy level up and fight this thing.

HEY! You're in the same district as me!
A side note regarding the senior senator for NJ. I take the Acela to DC occasionally and I see him on the platform at MetroPark sometimes. The look of contempt on his face when you say hello to him is priceless. He is a stereotypical elected official.
We should herf in Somerville some time! Ashes N Embers is a great spot.
Funny thing is, Senator Menendez is the only one who has responded and shown his support for the bill so far.

What? I know the legislation is crazy, but that is not a part of it. What is your source on this?
This was a main fear from the beginning, and although they have not yet chosen to ban walk-in humidors, thanks in part to our first round of fighting to have a Premium Cigar rider sneaked into the OMNIBUS to preemptively strike the FDA (didn't make it into the bill, but fanned the flames), industry experts are basing their predictions on a few things within the Final Rule's hundreds of pages ( https://www.federalregister.gov/articles/2016/05/10/2016-10685/deeming-tobacco-products-to-be-subject-to-the-federal-food-drug-and-cosmetic-act-as-amended-by-the#h-10):
  • Section 1140.14—Additional Responsibilities of Retailers which they state they are "still finalizing".
  • "Additional Provisions" contained in the Summary of Major Provisions where they state the authority to "invoke its other authorities under the Tobacco Control Act in regulating these products." but are currently only invoking some of them.
They warn that either from that unfinalized section (or a decision at any time later down the road by the FDA to invoke more powers it has under the FD&C Act (21 U.S.C. 387f(d))) you could be looking at a time where you couldn't smoke at a cigar shop/bar/lounge, walk into a humidor, or even the requirement of barring shops from letting their products be visible to anyone outside the store by putting up blacked-out windows like a freakin' porn shop.

· Worst of all: The outlawing of Cigar Bars and Lounges. That right, no more community of friends smoking cigars. In fact, you won’t even be allowed in the humidor. Only the owner can go in to it, not even employees! It will probably mean that your local shop will close their doors.
This is not true, at least in the current form of the regulations.

Great read, but very depressing. The sky might not be falling, but it's starting to drizzle. It's total Federal overreach. One-size-fits-all guidelines, because they're too lazy, or too stupid to do their homework. We make up 3% of total cigars sold/consumed in the market, teenagers DO NOT smoke premium cigars. All they had to do was enact Option II, exempting premium cigars over $10. Why didn't they do that? Whyyyyyyyyyyyyyyyyyyyyyyy?!?!?!?!?!?!?!?!!?!?!?! Let's just hope those morons in the House of Representatives vote to exempt premium cigars from these absurd and disgraceful FDA guidelines.

I concur. The more I read, the more depressed I get. Especially when we can only get together less than a tenth of the signatures needed for a petition.

In the year that I have worked at Straus We have had one person who did not have ID and was obviously underaged. We ID when they enter if they look under 25. We also do not sell anything a kid would want. Like- Black and milds, swishers, blunts, leaf wrappers, glass pipes, e cigs, etc...
We are a traditional Tobacconist with PREMIUM Cigars, Briar and Meerschaum pipes and High end or premium Pipe Tobacco. No big bag tobaccos or alike. With things the way they are over 60% of our stock would have to be pulled with no reimbursement and that's just the start. I had the pleasure of getting to talk to Steve Saka this week when he stopped into the shop and he expressed the same fears that we have. That if these regulations stay as they are he will go under and we will also. His company is new, ours is 136 years old. It's painful to see such a small amount of the cigar community taking this seriously and or down playing the reality of what the outcome will look like.
