I can't speak for Texas but I do know in Colorado, it doesn't matter if you are on the clock or not....we have had several incidents where people have slipped, tripped, fell on their way to and from the car in the parking lot, and all of them were considered Workman's Comp cases.

They could try but would have a very difficult time since they already submitted payroll.
